West Virginia DNR Wildlife Resources Section Files Legislative Rules for Review

The Wildlife Resources Section of the West Virginia Division of Natural Resources has filed legislative rule changes with the Secretary of State’s office, according to Curtis I. Taylor, Chief of the Division’s Wildlife Resources Section. The proposed rules will be open for review and written comment until 10 a.m. August 31, 2012. The availability of the proposed rules will be advertised in the State Register. In addition, the proposed rules will be available for review at each DNR district office, the Elkins office and the South Charleston office. Individuals interested in reviewing the proposed rules should contact the Wildlife Resources Section staff at these offices.

General Trapping Rule
Minor modification to language relating to the size of foothold traps which can be set under water, and the addition of state forests to those public areas in which a trapping permit is required.
Defining the Terms Used in all Hunting and Trapping
Modifications to this rule include removing language relating to amber, red and green lights for hunting coyotes at night.
Special Waterfowl Hunting Rule
Revisions to this rule include the removal of language pertaining to the management zones for waterfowl, modifying the language pertaining to the definitions of bait and baiting, and modifying the age of the accompanying licensed adult during the youth waterfowl season to make the age requirement consistent with the other youth hunting seasons.
Special Fishing Rule
The proposed rule change represents a clarification in establishing the no use of live minnows in certain waters as established in Series 60.
Special Boating Rules
The proposed rule change represents a change to the boating regulation for Ridenour Lake from no boating allowed to rental boats only.
Deer Hunting Rule
Revisions to this rule include language which addresses the checking requirements for deer relating to the change in the deer daily bag limit to two for all deer seasons, and modification to language which prohibits small game hunting during that portion of the antlerless deer season which coincides with the first three days of the buck firearms season.
Falconry
This rule revises the current legislative rule relating to falconry to be in compliance with recently passed Federal Regulations §50CFR21.
