Texas Home Owner Jailed for Firing Warning Shot into the Ground

Kay Ward, wife of Terry Nye, was woken in the middle of the night to sound of a bang at her bedroom window. She then glanced outside and saw the nearby fence shaking. “They were trying to break in, they were trying to break in” she told Dallas Fox 4. “I was terrified. I was literally shaking like a leaf.”
Nye said he could see intruders and he went out the back door. “I could see men through the fence and I told them they needed to leave my property and leave me alone.” He said. Then Nye discharged his weapon into the ground in an attempt to scare them away.
One of his neighbors called 911 after hearing the shot. When the police arrived they handcuffed Nye and took him jail.
He has been charged with discharging his weapon in a metropolitan area.
“I take care of my life. I pay my taxes. I own my property and I’ve earned it. And now I’m facing jail time for not being the victim of a crime and for not hurting anybody,” said Nye.
